When you place an order through AppleDisplays.com or with BG Expo Group, LLC directly you agree to the following terms:

WARRANTY

BG EXPO GROUP, LLC guarantees their product under a series of warranties for manufacturing defects covering ALL DISPLAYS ON OUR ON/LINE CATALOG. Under the warranty policies, a product believed to be a manufacturing defect will be repaired and/or replaced upon inspection of the issue.

The customer is responsible for shipping the product to BG EXPO GROUP, LLC for inspection. At the Discretion of BG EXPO GROUP, LLC, if the issue is deemed a manufacturing defect, the product will be repaired and/or replaced and returned to the customer at no cost with standard ground shipping during the first year of the warranty period. For products with a warranty period of over 1 year, the customer is responsible for the inbound shipping costs as well as the outbound shipping costs after the first year. Free replacement products cannot be sent until an assessment of the supposed defective product is made. At the discretion of BG EXPO GROUP, LLC, if the received product is deemed not to be a manufacturing defect, the customer will be notified and the product may be repaired and/or replaced at the customer’s cost. Shipping charges will be the customer’s responsibility for any items needing expedited shipping. Issues that are not covered under the warranties include but are not limited to:

• Standard wear and tear usage
• Mistreatment of product
• Unauthorized alteration
• Natural disasters
• Failure to follow product instruction sheets and labeling
• Incorrect use
• Theft
• Loss
• Vandalism
• Destruction
• Damages occurred while in transit

REPLACEMENTS & REPAIRS

Upon the acceptance of delivery, you agree that the package(s) have arrived without any visible shipping damage. If shipping damage is noted, sign for the delivery as damaged and contact BG EXPO GROUP, LLC immediately. Failure to sign for the package(s) as damaged, refusal of the package, or neglecting to note after 3 business days any damage that may have occurred during the shipping process will be treated as a warranty claim and are subject to the terms and conditions of our warranty. The option to issue a return label/call tag is at the discretion of BG EXPO GROUP, LLC for any warranty or claim situation, and any product outside of 72 hours will not have the option for a return label/call tag.

Any errors occurred during the shipping/freight process that shipped under the BG EXPO GROUP, LLC prepaid freight service will be guaranteed and covered should the shipper lose, damage, or delay a product outside their guaranteed delivery time. BG EXPO GROUP, LLC will process the claim information and replace the affected product. For orders shipped using a customer’s shipper number or a third-party shipper number, the customer will be responsible for replacing the affected product at cost and following through with the claim through the shipping/freight company. BG EXPO GROUP, LLC will begin the claim process and provide the customer with the claim information. Any further claim correspondence will be between the customer and the shipping/freight company.

BG EXPO GROUP, LLC reserves the right to request documentation in the forms of photos, copies of packing slips, and the like to ensure the issue is resolved promptly. “Standard questions” may also be asked in order to provide accurate and timely customer service. Failure to provide the necessary information requested by a BG EXPO GROUP, LLC Representative may delay the claim process. An RMA/Case number may be issued depending on the warranty/claim. This number must be used in regards to all correspondence with the issue and adhered to any packaging sent to BG EXPO GROUP, LLC for assessment. Failure to adhere to RMA/Case information to a package will delay the claim/warranty process.

Should you need to return a product due to order cancellation or any reason other than a warranty matter, BG EXPO GROUP, LLC reserves the right to carry out a full inspection of the product before accepting the return. All returns of this nature must be noted to a BG EXPO GROUP, LLC Representative 72 hours after receipt of the product and are susceptible to a 25% restocking fee/charge.

BG EXPO GROUP, LLC will not accept the return of a used or custom-made product or graphic. The product should be returned in the manner in which it was received. Order cancellations must be confirmed and approved by a BG EXPO GROUP, LLC Representative. The cancellation of a production order for which BG EXPO GROUP, LLC has produced or ordered raw materials may result in BG EXPO GROUP, LLC fully charging for materials and labor, or imposing a minimum cancellation fee of up to 50% of the purchase/sale price.

BG EXPO GROUP, LLC reserves the right to change prices or product designs as well as discontinue a product at any time without further notice. We are continually improving and modifying our product range and reserve the right to vary the specifications without prior notice. All dimensions and weights quoted are approximate and we accept no responsibility for a variance.

If a product is noted as defective that is a discontinued product, an exchange to an equivalent product will be offered or an upgrade to a premium product (at the discretion of BG EXPO GROUP, LLC) will be available with the customer responsible for the difference in cost.

If an item is entered in a claim and is deemed accepted for replacement, this replacement will be made with the same product (if available) and based on the same (original/approved) file. BG Expo Group will not replace a claimed product for a different model or based on a different file other than the original, previously approved by the client.

RETURNS

Return can only be accepted within 72 hrs of product receipt, and returns will only be accepted in like-new items. The option to issue a return label/call tag is at the discretion of BG EXPO GROUP, LLC for any warranty or claim situation, and any product outside of 72 hours will not have the option for a return label/call tag. Products that don’t meet the like-new conditions will not be accepted for return.

All shipping expenses to and from our facilities will be resposability of the customer.

SERVICES

ALL OUR SERVICES ARE PREPAID. Purchase orders will begin processing once the official purchase order is received (via fax, email, or mail) and verified and official payment form is received and processed.

Due to the expedited nature of our product once your order is placed and payment verified it enters the production cycle. For this reason, orders can not be changed once they are placed. Please verify all information before you submit your order.

LIABILITY

We are not liable for the package once it leaves our warehouse. You must save your original packaging material when making a claim with any carrier. Any refused shipments will still be billed the full amount of the original order, including shipping charges, due to the customized nature of our product.

BG Expo Group, LLC liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect, or similar damages, including without limitation, lost profits. BG Expo Group, LLC warrants that every product manufactured by it meets industry standard for such products and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. BG Expo Group, LLC makes no other warranty and no actions or words of BG Expo Group, LLC or its officers, employees, or agents shall constitute a warranty.

The 5% discount coupon applies only to on-line purchases. It cannot be applied to phone orders. And it cannot be combined with other discounts. Not for sale items either.

OWNERSHIP OF ARTWORK

All images provided remain the property of the copyright holder and will not be published, exhibited, broadcast, posted on the Internet, sold, traded, shared, or used in any way not specified in this agreement without the written permission of copyright holder.

During the routine course of business BG Expo Group, LLC will take photographs of completed displays, banner stands, and exhibits and may use these images on its website and in promotional material.

All graphic design elements (referred to as artwork in these terms and conditions) created by BG Expo Group, LLC are the property of BG Expo Group, LLC until the artwork rights have been purchased, at which point the artwork becomes property of the purchaser (referred to as the Customer in these terms and conditions). The elements of design work for the project remain BG Expo Group, LLC property, and BG Expo Group, LLC retains the rights for usage. This means you own your finished product but we reserve the right to the elements used to create the design, including typography, patterns, stock art, textures, and shapes, etc. Other than for the promotional use of BG Expo Group, LLC, all services provided by BG Expo Group, LLC shall be for the exclusive use of the Customer’s said purposes only. Designs may not be used for other promotional items, websites, or printed materials without permission. Upon payment of all fees and expenses, reproduction rights for all approved final designs created by BG Expo Group, LLC for the project shall be given to the Customer. The Customer automatically grants permission to BG Expo Group, LLC to showcase their artwork, created by BG Expo Group, LLC, on the BG Expo Group, LLC website or its promotional materials. It is understood that no artwork displayed on the BG Expo Group, LLC website can be used for any other purpose, by any individual or company except the purchaser of the graphic design and/or the party/parties given permission by the purchaser to use the artwork.

COPYRIGHTS AND TRADEMARKS

Copyrights are very important but they can be confusing at times. Put simply, by contracting or using all or any portion of the services provided by us, you agree to not hold us responsible in any litigation or court order that may arise out of your failure to obtain copyrights of the photograph(s) used. Here is a brief summary of what you will be agreeing to when using our service:

You are agreeing that you own or have the right to use any picture or photo you upload to our website and/or submit to our company.

RIGHTS OF THE IMAGE(S)

I hereby certify, authorize and warrant that I am the owner of the copyright or am authorized by the owner of the copyright, or own the full rights to any of the content of any and all image(s) to be uploaded on the website. I have written releases from the owner(s) of any and all copyrighted images I will upload to the website and/or submit to BG Expo Group, LLC.

AFTER PAYMENT

BG Expo Group, LLC is responsible for sending artwork in the form of e-proof, for which valid payment has been received, to the Customer. Once this artwork/e-proof has been received by the Customer, however, BG Expo Group, LLC is no longer responsible for the artwork, though BG Expo Group, LLC will continue retain the artwork within its digital files.

RIGHT TO REFUSE

BG Expo Group, LLC reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. The client expressly understands that BG Expo Group, LLC, its subsidiaries, agents, employees, and/or parent company, are not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. The Client represents and guarantees they have proper and legal title of all matter (of any form) submitted to our company for printing and/or publication. The client further understands that BG Expo Group, LLC will rely upon such representation as grounds to engage in the printing of the Client’s material.

ERRORS

In the event that an error is discovered in the Client’s job after printing, the Client bears sole financial responsibility and must pay in full for the job. The client agrees that in the event BG Expo Group, LLC is liable for an error in the quality of print in the Client’s artwork, liability shall be limited to a reprint of the client’s job no later than one (1) week after submission of claim letter by Client. To qualify for a reprint, the client must submit a claim in writing to BG Expo Group, LLC within three (3) days of receipt of the job. In no event will BG Expo Group, LLC be liable for any damages beyond those set forth in this paragraph, or for any general, consequential, or special damages that are claimed to follow by reason of the error. BG Expo Group, LLC is not liable for failure to print the Client’s job because of a flood, fire, riots, strikes, national holidays, and shortages of material, orders of government, failure of transportation, illness, acts of God, or other causes beyond the control of BG Expo Group, LLC. In such an event, this agreement will be suspended during the period of inability to perform and the terms extended for a like period. Neither party shall be liable to the other because of this suspension.

INDEMNIFICATION

The customer will indemnify and hold harmless the printer, BG Expo Group, LLC, its subsidiaries, agents, employees, officers, and/or parent company, from any and all loss, cost expense, and damages on any and all manner of claims, demands, actions and proceeding that may be instituted, whether known or unknown, against BG Expo Group, LLC on the grounds that said printing violates any copyright or any proprietary right of any person or entity.

TYPOGRAPHICAL ERRORS

In the event that a BG Expo Group, LLC product is mistakenly listed at an incorrect price, BG Expo Group, LLC reserves the right to refuse or cancel any orders placed for products listed at the incorrect price. BG Expo Group, LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, BG Expo Group, LLC shall issue a credit to your credit card account in the amount of the incorrect price.

RIGHT TO ADJUST PRICES

BG Expo Group, LLC reserves the right to change our product’s prices at any time without further notice.

BG EXPO GROUP, LLC guarantees the quality and functionality of its products when used in the correct manner as illustrated on each product’s instruction sheet.

Failure to comply with Warranty Terms and Conditions may result in additional charges and fees, determined at the discretion of BG EXPO GROUP, LLC. In cases of warranty disputes, BG EXPO GROUP, LLC reserves the right of the Final Judgment and/or decision on the nature and cause of damage and the fair and applicable warranty response and/or solution.
